| This acceptable use policy and terms and conditions of use applies to all users of EdSite. It is designed to enhance your learning and working environment and to enable everyone to use EdSite effectively.
1.1 Registration and Use of EdSite indicates your full acceptance of the terms and conditions of these terms and conditions of use. You may use the EdSite if you are:
i) a Student currently registered for any undergraduate or postgraduate course in the UK
ii) an Employee of a University in the UK with a recognised position as a Lecturer
iii) a Researcher or Fellow providing good reason to use the facilities of EdSite.
1.2 Internet use and bandwidth is monitored and controlled to ensure compliance with our ISP DataCentre Acceptable Use Policy, the Computer Misuse Act and the operational and usage requirements of ISP. Unfair or overuse of the system will result in that use being notified and if necessary restricted from using EdSite
1.3 Learning Centre users must observe and comply with all information notices within the centre.
1.4 All users are expected to conduct themselves in a quiet, orderly manner at all times. Persons making undue noise in the Centre will be cautioned and asked to leave.
1.5 Passwords may not be disclosed to anyone. Registered users of EdSite must NOT divulge details of their passwords to anybody for any reason, nor allow anybody to access EdSite facilities in their name. If users believe that their username and password has been compromised, this must be reported.
1.6 As a registered EdSite user you will be allocated an e-mail account. This will be used by EdSite as a primary means of electronic communication. You are expected to read your EdSite e-mail on a weekly basis and respond as required by EdSite.
1.7 As a registered EdSite user you are responsible and accountable for all actions taken through your account. You are also responsible and accountable for all infringements to criminal and/or civil law made from your account.
1.8 You must not use EdSite's services to threaten, intimidate, defame or otherwise harass any person or organisation.
1.9 All users of EdSite agree to conform to the requirements of the Data Protection Act, which regulates the storage of personal information. Before storing any such information you must notify EdSite. It is YOUR responsibility to ensure that any such information complies with the law.
1.10 You must not alter, disrupt, damage or maliciously use EdSite. Neither may you deface, repurpose or misuse or misrepresent EdSite by the use of its services.
1.11 All copyright laws and the terms of suppliers' licence agreements must be observed at all times. Further information relating to the Copyright Licensing Agency, Newspaper Licensing Agency, Education Recording Agency, Ordnance Survey, Federation Against Copyright Theft (FACT), Federation Against Software Theft (FAST) and Internet Enforcement Group should be consulted by you in order to comply with this condition. All forms of unauthorised media duplication are criminal offences and are expressly forbidden.
1.12 If you store, upload, borrow, download etc images, music, data or any other licensable materials, you must comply with their terms and conditions of use at all times
1.13 EdSite reserves the right to disclose any email address and other account information subject to the approval of EdSite or designate in compliance with the current version of the Data Protection Act.
1.14 EdSite accepts no responsibility for loss or theft of or damage to personal data at any time.
1.15 EdSite is authorised to inspect any data stored on EdSite as a matter of routine to ensure the stability of the EdSite service. This will be done either as a virus scan or the request of the legal authorities in the UK. We will not divulge your work, ideas or infringe your copyright.
1.16 Your completed registration with EdSite entitles you to use EdSite for your own college or personal work. No charge is normally made. However, certain facilities (such as the recovery or retrieval from backup / archive of your data) will be chargeable at the current cost rates of £85 per 650Mb.
1.17You are prohibited from using or installing software that has not been authorised by EdSite or software that does not belong to you.
1.18 You must not do anything which might cause harm of any sort to any EdSite system anywhere or to any of the programs or information on EdSite. You must not allow harm to occur by your negligence (the term 'harm' includes any kind of damage and any kind of unauthorised access or alteration).
1.19 If you are reasonably requested to do so, you must justify your use of the system. You must explain (in confidence, if necessary) what you are doing, and how and why you are doing it. If requested you must provide your personal ID details and proof of your identity. You must make any reasonable changes requested and comply with any reasonable restrictions placed upon you by EdSite.
1.20 It is your responsibility to ensure that all your data is secured or a backup copy or copies stored by yourself other than on EdSite.
1.21 You must comply with all legal regulations covering the use of software, data or digital media as regulated by UK law and the law of the country you are resident in, with UK law taking precedence as the default. Unless you have ownership permission or copyright you must not copy, share or make it available to anyone else any digital media, information, image, data or medium of any type or format.
1.22 EdSite may immediately suspend access to the system to any person suspected of contravening any of these conditions. After enquiries EdSite may re-instate access to EdSite or take legal advice. Contravention of any of these conditions also renders the person responsible liable to legal action.
1.23 Whilst every reasonable endeavour is made to ensure that the EdSite systems are available as scheduled and function correctly, no liability can be accepted by EdSite for any data loss or delay as a result of any equipment malfunction by EdSite or any third party.
1.24 Whilst every reasonable endeavour is made to ensure the integrity and security of information held onEdSite no liability can be accepted as a result of data being lost or corrupted or inappropriately accessed.
1.25 You must not access, or post any content which is obscene, offensive, libellous or pornographic. If a serious offence occurs the EdSite reserves the right to refer the matter to the police.
1.26 In accordance with best practice guidance regarding the protection of children and vulnerable adults EdSite reserves the right to notify professional bodies of breach of conduct in relation to offensive material. EdSite reserves the right to refer the matter to the police.
1.27 You must NOT try to gain unauthorised access to any of the Services on EdSites anywhere.
1.28 Failure to comply with the EdSite Acceptable Use Policy may result in the immediate withdrawal of all permissions for the Services. Legal action may be invoked.
